U.S. State Law Privacy Disclosure

Introduction

This additional state-specific privacy disclosure ("Disclosure" or “Notice”) supplements the Privacy Policy of Standard Payments, LLC and its affiliated brand companies (“we”, “us”, “our”) and should be read in conjunction with it.

Categories of Personal Information Collected

Depending on which services you have requested, or positions to which you may have applied (including to be part of our service provider network), we may collect the following types of personal information, as applicable:

  • Identifiers (e.g., name, postal address, email address, phone number, Social Security number, state identification number)
  • Geolocation information
  • Internet or other electronic activity (e.g., browsing history, devices, networks)
  • Commercial information (such as products or services purchased, W-9 information)
  • Transactional information (e.g., orders, credit card information, bank account or other payment information)
  • Professional information (e.g., resumé and social media information, skills, qualifications, licenses, associations)
  • Education information (institution attended, degree)
  • Health information (such as vaccination-related information, information on injuries, reasonable accommodation information)
  • Citizenship, immigration status
  • Demographics (e.g., age, sex, race, date of birth, education, occupation, veteran or military status, sexual orientation)
  • Audio, electronic or visual information (such as phone calls, voicemail, voice recordings, photos, videos)
  • Inferences (e.g., your preferences)

Any other personal information you disclose to us or which you consent to be disclosed to us.

Sources of Personal Information

  • Directly from you or your device (through information you provide to us, or which is automatically collected)
  • Current customers, vendors and prospects
  • Business contacts
  • Industry associations
  • Our affiliates
  • Your employer, where applicable
  • Service providers, contractors and vendors who provide services on our behalf
  • Data brokers (e.g., in connection with background checks)
  • Social networks (e.g., LinkedIn)
  • Government entities
  • Other individuals (e.g., in connection with referrals, feedback).

Categories of Personal Information Disclosed for Business Purposes

The personal information that we may have disclosed for a business purpose identified in the "Sharing Personal Information” section of our Privacy Policy fall into the following categories under state privacy laws, depending on the brand of services requested or positions to which you may have applied (including to be part of our service provider network):

  • Transactional information, such as credit card or other payment information, to pay invoices and to process payments, through financial institutions and third-party processors;
  • Information that may reveal demographics, e.g., if you choose to participate in a survey through a service provider;
  • Commercial information, such as products or services you purchased for a fulfillment vendor to deliver to you;
  • Internet information, including to a vendor fulfilling orders or helping us to prevent fraud or other unauthorized activity;
  • Audio or visual information, e.g., to a customer service vendor for quality or for verification purposes;
  • Identifiers, e.g., a vendor to verify your identity, certain ID you may provide for ID verification, may reveal your citizenship;
  • Taxpayer ID (such as your Social Security number if you apply for a job, to a background check provider or an EIN if you are a vendor we are paying, to financial institutions);
  • Education information, should you apply for a job, and we use a service provider to perform a background check;
  • Professional information, for example, if we provide your information to a service provider to verify your information;
  • Inference information, should we use a service provider to help predict your interest in our products or services;
  • Health information, for example, if we provide workplace injury information to our insurer and
  • Otherwise, where permitted by law, to fulfill our legitimate business interests.

We may also disclose personal information to (a) tax authorities and service providers, for tax and other regulatory filings; (b) to law enforcement or other government entities to cooperate with investigations, to respond to requests and to otherwise comply with law; (c) third parties to bring, defend or settle claims; (b) our professional advisors to receive advice for our business; and (c) prospective investors in connection with a merger, divestiture, reorganization or other transfer of our assets, or due diligence relating to such activity.

Aggregate and Deidentified Information

We either maintain such data without attempting to re-identify it or we treat it as personal information under applicable law.

Children and Teens

None of our Sites are directed at children and we do not knowingly collect personal information from children under age 13. If you are under age 18, you may only use our services with the involvement of a parent or guardian.

Rights Under State Law

Depending on your place of residence, you may have certain rights under state law, including to request:

  • A copy of the personal information we have about you;
  • Categories of personal information we collect, use, disclose, and sell or share for cross-context behavioral advertising;
  • To correct your personal information if it is inaccurate;
  • To delete the personal information, you have disclosed to us; and/or
  • To an appeal of a decision we have made in connection with the above requests.

We will need to verify your identity before acting on your request. We verify identity by comparing information we have about you with information you submit to us. For requests to access, delete, and correct your information, we may also send an email to you, asking that you confirm that we have the correct email address within ten (10) days of receiving the confirmation email or your request may expire. If you do not see an email from us, please check your spam folder.

Depending on your place of residence, you may also be able to make a request on behalf of another individual, where you are authorized to do so. If you are an authorized individual, you will be required to submit your contact information (including your email address) as well as information about the individual for whom you are making a request. You will receive an email confirming that we have received your request and if you have not already done so through our Webform, a second email asking you to fill out a certification confirming your information and certifying your right to make a request on behalf of the individual.

Personal Information Sold or Shared with Third Parties

We may share your personal information with advertising partners to target advertisements to you and to measure the effectiveness of such advertising. Certain advertising partners may combine personal information into a customer profile. We may also disclose your information to our business partners who may use it for additional purposes relevant to our products or services (e.g., joint marketing, or joint product and services offerings). This disclosure may be considered a “sale” or a “share” under applicable laws.

No Automated Decisions

We do not profile consumers in furtherance of automated decisions that produce legal or similarly significant effects, as those terms may be defined under applicable law. Nor do we use automated decision making.

No Discrimination

We will not discriminate against any consumer for exercising rights under applicable law.

Data Retention

We will retain personal information for the period required or permitted by law, for the time reasonably necessary to achieve the purposes described in our Privacy Policy or any other notice provided at the time of collection. Retention is based on several factors, including legal requirements, statutes of limitation and business needs.

Updates

We may update this Notice from time to time with changes and revise the date of the Notice. We encourage you to check back periodically and to review the current version.
